1. Store Users, Trader Users, Buyer Users, Seller Users, Market Seller
Users, Service Provider Users and all other Users on this website agree
to conduct their activities in a lawful manner and in a manner that
doesn’t breach any of the laws of the Federal Republic of Nigeria. Any
breach of this condition shall result in suspension or termination of the
user account of the breaching party.
2. Store Users, Trader Users, Seller Users, Market Seller Users agrees
that he or she is the bonafide owner of the item or property being sold
on this website or that such item is being sold with the consent of the
owner. Any breach of this condition shall result in suspension of the user
account until the breaching party shows that the owner of the property
or item has knowledge of the posting.
3. Buyer User agrees that he or she is not buying any property or item
from TalcTech Nigeria Limited but rather is buying them directly from
the respective sellers that sell those properties and items, with TalcTech
Market being a mere facilitator of their transactions with the respective
sellers.
4. Buyer User agrees that upon payment of the shipping fees/costs, he
is deemed to have entered into an independent contract with the
delivery company that’ll deliver his product and that neither TalcTech
Nigeria Limited nor TalcTech Market is a party to this contract.
5. Buyer User agrees that neither TalcTech Nigeria Limited nor TalcTech
Market is an agent for the respective sellers operating on our platform
and all transactions with sellers are an independent contract solely
between the Buyer User and the respective seller(s).
6. Buyer User agrees that neither TalcTech Nigeria Limited nor TalcTech
Market is a third party to or is in anyway involved in any contract
between the Buyer User and the respective seller(s).
7. Buyer User agrees that TalcTech Nigeria Limited is not responsible for
the state in which any product purchased on TalcTech Market is
delivered, the fitness of that product for the purpose it was bought, any
defect in the product, the late delivery of the product or if the product is
not delivered at all. Buyer User agrees that these obligations rest with
the seller of the product and the delivery company.
8. Buyer User agrees that TalcTech Nigeria Limited is not responsible for
the behaviour of or crimes committed by staff of the delivery company
that delivers his product, and also agrees to waive all rights to sue
TalcTech Nigeria Limited for any harm suffered as a result of such
actions or crimes.
9. Store Users, Trader Users, Buyer Users, Seller Users, Market Seller
Users, Service Provider Users and all other Users on this website agree
that they shall take necessary precautions to verify all statements,
representations and information made or given by any of the users of
this platform, that they shall thoroughly take all precautions during their
dealings with other users of this platform.
10. Store Users, Trader Users, Buyer Users, Seller Users, Market Seller
Users, Service Provider Users and all other Users on this website agree
that TalcTech Nigeria Limited reserves the right to amend, make
additions, or make subtractions to these “Terms & Conditions” after
giving a 21 days notice to that effect.
11. Store Users, Trader Users, Seller Users, Market Seller Users and
Service Provider Users agree to give TalcTech Nigeria Limited the power
to collect payment from Buyer Users on their behalf, hold such
payments for anytime up to a month, and make payments to their
respective accounts upon satisfaction by our company that the Buyer
User has gotten the product in satisfactory conditions.
12. Store Users, Trader Users, Seller Users, Buyer Users, Market Seller
Users, Service Provider Users and all other users on this website
authorize TalcTech Nigeria Limited to charge them monthly user account
fees & charges as required by our company, and to charge a penalty fee
(not more than 18 months monthly fees) in the event that the monthly
fees are not paid for more than two months.
13. Store Users, Trader Users, Seller Users, Buyer Users, Market Seller
Users, Service Provider Users and all other users on this website agree to
waive all rights to sue TalcTech Nigeria Limited for any harm suffered as
a result of any information gotten from TalcTech Market or from any
other TalcTech platform.
14. Store Users, Trader Users, Seller Users, Buyer Users, Market Seller
Users, Service Provider Users and all other users on this website agree to
waive all liabilities against TalcTech Nigeria Limited for any harm
suffered as a result of products bought from or services rendered by
users of TalcTech Market or any other TalcTech platform.
15. Store Users, Trader Users, Seller Users, Buyer Users, Market Seller
Users, Service Provider Users and all other users on this website agree to
waive all liabilities against TalcTech Nigeria Limited for any harm
suffered as a result of use of TalcTech Market or any other TalcTech
platform.
16. All users on this platform agree never to engage in any act of
harassment against any other user of this platform.
17. Store Users, Trader Users, Seller Users, Market Seller Users and
Service Provider Users hereby authorize TalcTech Nigeria Limited to
collect a 5% Commission on the selling price of any item or property
purchased by any Buyer User on the TalcTech Market once the item is
bought and payment is received from the Buyer User. Store Users,
Trader Users, Seller Users, Market Seller Users and Service Provider
Users are only entitled to 95% of the selling price on each Buyer
Transaction.
18. Buyer User agrees to pay all charges that shall be imposed by
TalcTech Nigeria Limited on each of the Buyer User’s purchases or
transactions on TalcTech Market. Buyer User also agrees that these
“Transaction Charges” can be imposed or amended by TalcTech Nigeria
Limited without informing the Buyer User before hand and that the
statement of the amount charged on the Payment Page right before
Payment serves as sufficient notice to the Buyer User of the presence of
“Transaction Charges” and the amount charged.
19. Store Users, Trader Users, Seller Users and Market Seller Users
agree that any product delivered that is rejected by a Buyer User as
unsatisfactory will automatically trigger TalcTech Market’s internal
dispute mechanism as regards that transaction, and any decision made
by TalcTech Nigeria Limited on that issue becomes binding on all users
involved. In the event of a favourable decision in favour of the Buyer
User, the amount paid by the Buyer will be fully or partially refunded the
money paid on the transaction, without there being any kind of
compensation to the Store Users, Trader Users, Seller Users and Market
Seller Users.
20. Service Provider User agrees that any service rendered that is
contested by a Buyer User as unsatisfactory will automatically trigger
TalcTech Market’s internal dispute mechanism as regards that
transaction, and any decision made by TalcTech Nigeria Limited on that
issue becomes binding on all users involved. In the event of a favourable
decision in favour of the Buyer User, the amount paid by the Buyer will
be fully or partially refunded the money paid on the transaction, without
there being any kind of compensation to the Service Provider User.
21. Buyer User agrees that he or she is under obligation to accept all
products delivered to him or to return the product before any
depreciation in value, and that if TalcTech Nigeria Limited resolves that
there has been a depreciation in value of the product, the case will be
decided in favor of the vendor and the Buyer User will not be refunded
any money paid on the transaction.
22. Buyer User agrees that he or she is under obligation to accept all
products delivered to him if the product is a sealed product and he has
broken the seal on the product. No refund will be available under these
circumstances.
23. Buyer User agrees that in the event that he or she rejects a product
as unsatisfactory, Buyer User must hand such product to the
deliveryman for onward delivery back to the vendor and shall be
responsible for the cost of the return delivery to the vendor. This cost
will be deducted from the amount refunded to the Buyer User in the
event of a resolution in favour of the Buyer User.
24. All use of the word “vendor” refers to “Store Users, Trader Users,
Seller Users, Market Seller Users and Service Provider Users”.
25. Buyer User agrees that should he or she contest product delivered
or services rendered by the vendor as unsatisfactory, Buyer User shall
automatically become subject to TalcTech Market’s internal dispute
resolution mechanism and shall be bound by any decision made by
TalcTech Nigeria Limited on this transaction.
26. Buyer User agrees that in any dispute with a vendor, a resolution by
TalcTech Nigeria Limited against the Buyer User does not prevent the
Buyer User from bringing a legal action in court against the vendor over
that matter but rather it extinguishes any rights that Buyer User may
have to the purchase money of that transaction in dispute and prevents
the Buyer User from bringing a legal action against TalcTech Nigeria
Limited as regards refund of that purchase money.
27. Buyer User agrees that there exists an independent contract
between the Buyer User and each vendor that Buyer User purchases a
product or service from, and as such Buyer User has contractual rights
which he or she can enforce in courts and in all other avenues outside
TalcTech Market.
28. Store Users, Trader Users, Seller Users, Market Seller Users and
Service Provider Users agree that there exists an independent contract
between them and each Buyer User that purchases a product or service
from them, and as such they have contractual rights which they can
enforce in courts and in all other avenues outside TalcTech Market.
29. Store Users, Trader Users, Seller Users, Buyer Users, Market Seller
Users, Service Provider Users and all other users on this website agree to
waive all rights to sue TalcTech Nigeria Limited for any harm suffered as
a result of their suspension at anytime from using the TalcTech Market
Platform.
30. Store Users, Trader Users, Seller Users, Market Seller Users and
Service Provider Users agree that in the event of a dispute with a Buyer
User regarding a transaction, they shall be bound by the resolution
made by TalcTech Nigeria Limited on the matter, and in the event of a
resolution by TalcTech Nigeria Limited against them, they shall lose all
rights to request for the purchase money paid for that transaction or
bring a legal action against TalcTech Nigeria Limited regarding that
purchase money.
31. Buyer User agrees that any complaint he or she has on any product
delivered or service rendered must be made within 24 hours after
receipt of delivery or completion of service, otherwise TalcTech Nigeria
Limited may, at its discretion, treat such right to contest as having lapsed
and expired.
32. Store Users, Trader Users, Seller Users and Market Seller Users
agree that they are under obligations to prepare purchased products for
delivery and should delivery of such products be delayed or should they
fail to adhere to any Packaging Guidelines given by our company, they
will be deemed to be in breach of these “Terms and Conditions” and
may have their user account suspended from this platform.
33. Service Provider User agrees that should he or she fail to render any
service purchased within the time-frame specified, the Service Provider
User shall be deemed to be in breach of these “Terms and Conditions”
and may have his or her user account suspended from this platform.
34. Store Users, Trader Users, Seller Users, Market Seller Users and
Service Provider Users agree to adhere to all Guidelines and Instructions
that may from time to time be given to them by our company as regards
the packaging of products, delivery of products, rendering of services
and behaviour while rendering the services, and should they fail to
adhere to any of these Guidelines or Instructions, they’ll be deemed to
be in breach of these “Terms and Conditions” and may have their user
account suspended or terminated from this platform.
35. Store Users, Trader Users, Buyer Users, Seller Users, Market Seller
Users, Service Provider Users and all other Users on this website agree
that TalcTech Nigeria Limited shall not be responsible for any crime or
fraud committed by any of the users on this platform. We hereby
disclaim all liability, including vicarious liability, that may arise as a result
of actions or inactions of users of this platform.

29. Store Users, Trader Users, Seller Users, Buyer Users, Market Seller
Users, Service Provider Users and all other users on this website agree to
waive all rights to sue TalcTech Nigeria Limited for any harm suffered as
